As per MTP Act , there are laid down reasons (which fit in 5 categories) for getting an abortion . For getting an MTP there has to be a reason and it should fit into MTP Act.
So far, "impending divorce" is not a reason to seek MTP under the MTP Act.
From medical point of view an MTP performed at 19 weeks is certainly a dangerous procedure. It carries its own complications of which may be maternal death.
Thirdly an MTP performed at 19 weeks because of irrevocable differences between wife and husband culminating in divorce puts lot of avoidable responsibilities on the doctor. He should be prepared to get summons from the Court to prove the paternity of the foetus.
Fourthly if after a few months (or years) the husband and wife reconcile and they blame Doctors for misleading the wife into seeking an abortion , what will be the legal position of the Doctor ?
So it is not only medical knowledge and competence of Doctor , the Doctor has to plan in advance how is he going to face the LAW.
